WHAT DOES ADA STAND FOR?

ADA stands for the Americans with Disabilities Act (ADA), passed on July 26, 1990, by President George H.W. Bush. This milestone, civil rights law, was designed to increase accessibility and opportunities for the many Americans with disabilities and prevent discrimination against them. This law provides a guideline for Employment (Title I), State & Local Government (Title 2), Public Accommodations (Title 3), Telecommunications (Title 4), and Miscellaneous Provisions (Title 5).

WHAT ARE ADA DISABILITIES?

In 2008 the Americans with Disabilities Act Amendments Act (ADAAA) was passed to broaden the definition of disabilities to encompass many more Americans with accessibility needs. "The ADA defines a person with a disability as a person who has a physical or mental impairment that substantially limits one or more major life activity." While the ADA does not list all the disabilities that are covered under the ADA, Some of the significant life activities that would qualify under ADA are:

  • Seeing
  • Walking
  • Communications
  • Sitting
  • Reading

HOW DOES THE ADA AFFECT ME?

If you are a business owner, there are many rules and regulations in the ADA that pertain to you, from (Title I) covering Employment to (Title III) covering public accommodations such as Parking Lots, Bathrooms, Tables, Ramps, Bar Height, and more. Many business owners are not aware of these regulations covered under (Title III) of the ADA until they are hit with a costly ADA lawsuit. If you are a business owner in California, you are especially at risk; California has had more than 50% of all ADA cases in the US and increasing. Every year, the number of cases increases by 33%, with as many as 5,869 cases in 2020 alone. Getting the help of a Certified Access Specialist (CASp) can get your business protected from costly lawsuits and market your business to the almost 26% of Americans living with disabilities.
